Separate Data Protection Consent Form for the Purpose of Publication of your Personal Data on the MCCAA's website
A. BACKGROUND
The Flourinated Greenhouse Gases (Implementing) Regulations (Subsidiary Legislation 427.94 of the Laws of Malta) which implement the provisions of Regulation (EU) No 573/2024 of the European Parliament and of the Council of 16 April 2014 on fluorinated greenhouse gases and its implementing acts, designates the Technical Regulations Division within the Malta Competition and Consumer Affairs Authority (‘MCCAA’) as the competent authority for the purpose of Regulation (EU) No 573/2024.
In this regard, in accordance with the relevant provisions of Commission Implementing Regulation (EU) 2015/2067 establishing minimum requirements and the conditions for mutual recognition for the certification of natural persons as regards stationary refrigeration, air conditioning and heat pump equipment, and refrigeration units of refrigerated trucks and trailers, containing fluorinated greenhouse gases and for the certification of companies as regards stationary refrigeration, air conditioning and heat pump equipment, containing fluorinated greenhouse gases, holders must present a certificate as issued by the certifying body, attesting that the holder fulfils the requirements to undertake activities specified in the Implementing Regulation. Following presentation of this certificate, the Director General within the Technical Regulations Division issues an F-gas card to relevant holders attesting that the holder is in possession of the necessary requirements to perform such service.
B. PURPOSE
In the context of the above, the Technical Regulations Division is hereby requesting your consent in terms of Article 6(1) (a) of the General Data Protection Regulation, to publish your personal data (as specified in section C below) on the MCCAA’s website so that third parties would be able to have access to the list of authorised holders for prospective engagement of service.
C. INFORMATION TO BE PUBLISHED
The details that will be published on the website upon your consent are:
-Name and Surname (in case of natural persons);
-Category of the Card;
-E-mail address;
-Contact Number;
D. RETENTION OF RECORDS
If you consent to such publication, your personal details will be retained on the MCCAA’s website for a minimum period of five years.
E. YOUR RIGHTS AS THE DATA SUBJECT
-Right to be informed: you have a right to know what personal data about you is being collected, how it is being used, how long it will be kept and whether it will be shared with any third parties;
-Right of access: you have a right to request a copy of the information that the MCCAA holds about you;
-Right of rectification: you have the right to correct personal data that is inaccurate or incomplete;
-Right to be forgotten: you have a right to request that the personal data that the MCCAA holds about you is erased from our records in accordance with the circumstances;
-Right to restrict processing: you can request that the MCCAA limits the way it uses personal data about you;
-Right to object: you have the right to challenge certain types of processing.
-You also have a right to withdraw your consent for the publication of your personal details on the MCCAA’s website, in writing and at any time.

You are kindly also being made aware that if you do not consent to having your personal details published on the MCCAA website, the Technical Regulations Division within the MCCAA will not publish your personal details on the MCCAA website. In such cases, your personal data will be processed by the MCCAA purely for the purpose specified in the ‘Application Form for the Registration of Personnel involved in Maintenance and Servicing of Equipment utilising Fluorinated Greenhouse Gases’ above.
